Derrick Gaines killed by SSF Police Officer.

My condolences to his family and friends, We San Mateo County must put a stop to this if at all possible. The article said the police did not say what kind of gun he allegedly pulled out of his waistband which caused the unnamed officer to "fear for his life" which is the standard answer in these shootings.I think it would be helpful for the transparency factor if they identified the gun and was it real, loaded, kind of ammo etc. It also said "A lengthy investigation will be conducted by the San Mateo County District Attorney's Office." I am asking District Attorney Steve Wagstaffe to ref. this investigation to the Attorney General of the State of California based on my personal knowledge of favorable treatment towards law enforcement in the past by his office.

We must pull together and find a way for our citizens and Police Officers to be safe. If a gun was involved and pulled from the waistband kids and adults need to understand that would be a good reason to shoot period.

Michael:

let's not second guess. You weren't there. You can bet if I was and someone pulled a gun I wouldn't wait to find out if it was real, loaded or unloaded. You pull a gun on me and I'm armed, you're going to get shot. Period. It's a terrible thing, but if this person really did pull a gun on a police officer, he did a very stupid thing.

Michael is not second guessing. He said in his post that if a gun actually was pulled, that might justify this officer's actions. He also correctly recognizes that the San Mateo D.A. will not hold law enforcement accountable when they are wrong. This justifies the referral to the Attorney General of the State of California. This police department has not been forthcoming with whether a gun actually was pulled (versus "appeared" to be pulled) and that doesn't make sense.

Wagstaffe would say that the Mehserle shooting at Oakland Bart was totally justified also. This youth was shot in his back and there is no justification for this. I believe Steve Wagstaffe needs to be prosecuted for civil rights violations at the federal level. He has already been censured on this in terms of sanctionable conduct during a criminal trial.

Lets see, the kid runs from the cops, gets knocked down, a gun falls out of his clothes and he reaches for it in front of the armed officer that is in front of him. The officer fires on him because he's in fear of his life. Frankly, I don't see a problem here. You don't reach for a gun after you run from the police unless you're an idiot. I feel badly for the family's loss, but this officer didn't do anything wrong, the kid did.

The way you stop this is to not let your kid run wild in the streets using drugs and carrying a gun.

Menlo Voter,

I agree with you 100% and we must make sure that everybody understands if you carry a gun this is most likely going to be the outcome.

What I was asking for was an outside investigation to remove any questions that's all. We know that our District Attorney is a racist according to 3 judges, and we know he does Police Officer's criminal favors Atherton several times.

I'm not saying he's wrong on this one, it just would have been cleaner going outside.

Mr. Stogner, we both know that isn't going to happen. And if every DA in every jurisdiction "went outside" on every police shooting, the California Attorney Generals office would have nothing but those cases to handle. It's the system we have. Unless you can prove malfeasance in this case on the part of the D's office, there's no reason to suspect an incorrect outcome.
