Atherton To Disregard the Brown Act?

Original post made by Ready, Fire, Aim on Nov 25, 2012

In Atherton's Council Packets there comes this gem: Carlson and Lewis propose the Council reaffirm its commitment to the Brown Act.

Apparently, the State of California suspended certain parts of the law to offer municipalities some financial relief. Transparency, it turns out, is not free.

Carlson and Lewis refer to a "different view" by other Council members. Is this Council committed to transparency? Apparently there are some on the Council who are not!

FROM THE COUNCIL PACKET:

We believe it is important to clarify that our Council will continue to respect and abide by all of the principles of the Brown Act even though the California State legislature has suspended certain portions.

This request is being made at this time because apparently there is another view being put forth as to where we stand as a Council in abiding by the Brown Act.

I think that it is highly unlikely that the current council will elect to suspend the Town's Brown Act notification compliance (all other aspects of the Brown Act remain in effect) and if they do then I am certain that the new council will reverse that decision.

If I am wrong and the councils elect to suspend the Town's Brown Act notification compliance then I can guarantee that such a decision will be, at considerable economic and moral cost to the council, be overridden by the voters.

It's a shame that San Mateo County has not had James P. Fox and does not have Steve Wagstaffe a District Attorney who enforces the Brown Act.F
