Can you say "conflict of interest"? Do you really expect Menlo Park cops to do the right thing regarding these traffic camera scams when it's been sold to them on the basis that it will increase Menlo Park revenue, to help defray the compensation hits and retirement pension hits Menlo Park cops should be taking to balance budgets?

While your letter addresses the ethics and merits of the program, don't ignore the fact that the Menlo Park automated enforcement program is illegal.

Vehicle Code § 21455.5 (g) (1) states: “A contract between a governmental agency and a manufacturer or supplier of automated enforcement equipment may not include provision for the payment or compensation to the manufacturer or supplier based on the number of citations generated, or as a percentage of the revenue generated, as a result of the use of the equipment authorized under this section."

The contract between Menlo Park and Redflex (the supplier) has such a provision.

Any defendant who has made this argument in San Mateo court has gotten their ticket dismissed. Although some traffic commissioners ignore this issue, those defendants who have appealed it to a superior court judge have obtained justice 100% of the time.
