Car-pedestrian accident sent to DA
(January 19, 2005) Rather than arresting a 75-year-old Menlo Park woman who they suspect struck and injured a pedestrian with her car, police are forwarding the case to the San Mateo County District Attorney's Office.
The district attorney's office will then review the case and decide whether to prosecute, said Sgt. Jim Simpson of the Menlo Park Police Department.
"They may view it as nothing more than a tragic accident," he said.
Because the investigation is ongoing and the woman has not been charged, he declined to disclose the woman's name or explain why police chose not to arrest her.
Police say the woman's Lincoln Continental hit a woman who was walking her dog on the shoulder of Valparaiso Avenue in Menlo Park around 5:30 p.m. on December 26. The woman suffered serious injuries, perhaps a skull fracture, and is now recovering, police said. The dog reportedly got only a few scrapes.
The suspected driver has been cooperative with the police, who have not seen her as a flight risk, Sgt. Simpson said.
