Update

The case has been reset to May 23 at 8:45 a.m. for jury trial and to March 8 at 1:30 p.m. for a pretrial conference, after the District Attorney allowed the trial’s start to be delayed at the defense attorney’s request.

A pretrial conference for Edwin Gary Smith, 64, former owner of Menalto Cleaners in Menlo Park who is accused of unauthorized charges on customers’ credit cards, was held Oct. 13 in San Mateo County Superior Court.

Judge Leland Davis III set Nov. 17 as a date for a further pretrial conference. A jury trial date was reset to Feb. 16, 2016.

Mr. Smith, was arrested in January on charges of credit card fraud. District Attorney Steve Wagstaffe said there are 19 victims with losses of more than $350,000.

Mr. Smith posted a $350,000 property bond on Jan. 28 and has been out of custody since then.

  1. Come on, did the trial actually start? Was there a last minute plea deal? I can’t imagine that if it did go to trial that it would take more than a couple of days.

  2. The hearing to decide on a trial date for Mr. Smith was put off until June 7, according to a May 25 report by Assistant DA Al Serrato.
