Dr. Gillon's attorney, Anthony L. Label of San Francisco, said Dr. Gillon suffered "serious" personal injury and her losses included property damage, hospital and medical expenses, and the loss of income and earning capacity. She is seeking damages in excess of $25,000, according to the complaint.

Noel Kidd claim that Dr. Gillon "did not exercise ordinary care for her own safety and well being," that her facts are insufficient for a cause of action against Webb Ranch, that statutes of limitations apply, and that if a dangerous condition existed at the time of the accident, Webb Ranch had no "actual or constructive knowledge" of it.
