Webb Ranch denies claims in lawsuit over I-280 crash

Attorneys for Webb Ranch have filed a response to a lawsuit by Dr. Jean W. Gillon that accuses the ranch of negligence in connection with an accident on Interstate 280 in the early morning darkness in December 2012.

In the court filing, Webb Ranch denies all allegations made by Dr. Gillon in the civil complaint filed May 10 in San Mateo County Superior Court. The accident occurred at around 5 a.m. on Dec. 29, 2012, when the Mercedes Benz Dr. Gillon was driving collided with at least one of four Webb Ranch horses that had gotten loose and wandered onto the northbound lane of Interstate 280 just north of Alpine Road.

Dr. Gillon's attorney, Anthony L. Label of San Francisco, said Dr. Gillon suffered "serious" personal injury and her losses included property damage, hospital and medical expenses, and the loss of income and earning capacity. She is seeking damages in excess of $25,000, according to the complaint.

In their June 6 court filing, the Webb Ranch attorneys John N. Carr and G. Noel Kidd claim that Dr. Gillon "did not exercise ordinary care for her own safety and well being," that her facts are insufficient for a cause of action against Webb Ranch, that statutes of limitations apply, and that if a dangerous condition existed at the time of the accident, Webb Ranch had no "actual or constructive knowledge" of it.
