Jim Lewis files libel claim against City

I note that an article has appeared

that states that Palo Alto resident,Jim Lewis, has filed a claim against the City of Menlo Park alleging being libeled by council person Kelly Fergusson.

If this article is at all correct, and with the implication from the response of the City Attorney indicating that the City might pay Lewis in order to avoid a lawsuit, I find any such claim payment totally offensive.

This issue should be immediately brought out into the open; no settlement should be made without public oversight.

This is the same Jim Lewis who has just posted to the MP e-mail log a note titled

His claim against the City is certainly going to help stimulate the City's economy I guess.

Jim Lewis has discovered an economic stimulus package...for Jim Lewis. Sue a member of the city council and collect a chunk of change. Easy! Just send Jim $25 (cash or check only; trading stamps and IOUs not accepted) and he will tell you how you too can make some extra money in the comfort of your own home. Why do any honest work when empty threats will take you where you want to go!

Has anyone read the pdf that was attached to the email? Someone spent some time pasting together a lot of newspaper clippings including big photos of celebrities (I had some elderly aunts who were fond of the same pastime). After sifting through that material, you get to his stimulus package, which is chock full of good economic advice like "say please and thank you" and "re-establish the arts commission." Jim also suggests adding people to the staff to apply for grants and coordinate volunteers and handle other miscellaneous tasks. With personnel costs being our biggest expense, I think we need to focus on ways to reduce staff. Hiring more people isn't going to erase our deficit!

The city should not pay him one red cent, as it would likely just encourage him to "come back to the lawsuit trough" over and over again anytime his name is even mentioned by a city official.

Who on earth is this lawyer, and why would he participate in such a frivolous legal action? According to the article, Fergusson's email exposed poor Mr. Lewis "to hatred, contempt, ridicule and obloquy." I've got news for you silly boys: This legal claim is what exposes him to all of the above.

Fergusson was acting in her capacity as an elected official, and in that capacity has immunity from most lawsuits -- I'm sure one as stunningly stupid as Lewis's would fit in that category. Stop wasting the city's (i.e. the taxpayers') time and energy with your silly little games.

Why should he stop wasting his time when the city is about to throw him a big bone? It's worth $10k to shut him up.

I'll bet we can all think of ways we can get council members to insult us. Worth ten grand! Go for it!
