A 30-year-old Redwood City man has been sentenced to 10 months in county jail in connection with a July 2016 felony drunken driving incident in Woodside.

Duncan Crawford Burr pleaded no contest to the charge in March. San Mateo County prosecutors said a sheriff’s deputy found Mr. Burr on July 22 in a parked vehicle that was partially in a ditch near Godetia Drive and Jefferson Avenue in Woodside. The deputy said Mr. Burr was showing signs of intoxication.

Mr. Burr claimed to have been playing Pokemon Go with friends before deciding to take a nap, prosecutors said. But two breath samples indicated blood-alcohol levels in Mr. Burr of 0.15 percent and 0.14 percent, prosecutors said.

The April 7 sentence by Judge Jeffrey R. Finigan allows Mr. Burr to convert jail time to a residential treatment program after 60 days in jail, and he already has 52 days credit for time served, prosecutors said.

Prior convictions for DUI offenses converted his offense to a felony from a misdemeanor, prosecutors said.

The terms of his sentence include five years of supervised probation, abstention from alcohol, loss of his Fourth Amendment rights regarding search and seizure, avoiding establishments whose primary business is selling alcoholic beverages, an ignition interlock device for his car, and fines and fees totaling $2,229, prosecutors said.

  1. And to think this all could have been avoided if he just DID NOT GET INTO A CAR AFTER DRINKING!!!
    Please people, please people …… do not drink and drive.
    I hope he gets the treatment he needs and adopts the one day at a time way of life.

  2. Pro tip: do not drive BEFORE drinking. You have to get home somehow. After drinking, your judgement is terrible, so decide BEFORE drinking to not drive any more that day.

    In this particular case, the perp had multiple DUI convictions. I don’t know if any of the prior convictions resulted in jail time, but I am glad the judge took him off the street this time. While he’s in jail, he can’t kill an innocent person on the road. I wish that all DUI convictions resulted in jail time or at least mandatory intensive treatment.

  3. Duncan Crawford Burr is a recidivist drunk driver, and he’s only getting 60 days in CJ with 52 days credit for time served, so he’ll be out driving again in just a matter of days?!? Why was this recidivist drunk driver not given prison time?!?
