Note to Readers:
I have provided the Almanac News with documentation in support of allegations of misconduct within the Atherton Police Department. I have also provided this documentation to Chief Guerra.
As requested by the Almanac News, my post is edited to protect the names of the not-so-innocent.
As I have abided by the Almanac's desires, I ask that it abide by mine, to let the readers read what I have posted and to judge for themselves.
There can be no question that the Atherton Police Department has some bad apples.
Some would say that these bad apples have spoiled the whole bunch. Some would say that the Atherton Police Department is rotten to the core, that the whole bushel should be tossed out.
The City Council, led by Jerry Carlson remains in perennial denial and refuses to establish a police oversight committee.
I know the depths of corruption in the Atherton Police Department. I have seen it by my own eyes and I have suffered from the Police Department's abuses.
The Atherton Police Department sent two of its goons in to raid my office and to retrieve evidence I had assembled of criminal conduct by the [portion removed] in charge at the time, Rober Brennan. I had intended to give this evidence to our auditors to ask them to comment on the need for improved controls over the use of the Town's credit cards by the Police.

Then there is another up and comming officer in the police department. A former member of the Santa Clara County REACT task force, a celebrated member of this community. He is the one who tampered with the laptop computer I returned. The end result being naughty pictures having been "discovered" on the computer I returned to the Town.
According to sources close to the City Council, (Not Kathy McKeithen mind you) is that those naughty photos "discovered" by a former member of the REACT task force is what turned Jerry Carlson against me.
These naughty photos were displayed in closed session to the whole Council. For evidence all one needs to do is read the transcript of Mary Topliff's deposition.
I was not given the opportunity to refute this so called evidence, to question its origin. Because the City Council tried me in abstentia, in secret and in violation of the law.
I have documentation that the Atherton Police Department violated my right to privacy by conducting forensics on the laptop computer I returned without a search warrent.
I have documentation that the Atherton Police Department falsified official records to conceal its misconduct in my case just as it did in Jon Buckheit's case.
I have documentation that both Chief Brennan and Chief Nielsen violated California Penal Code Section 424. I have made my complaints known to Chief Guerra.
Why then give Chief Guerra a chance? Because in filing a complaint over police misconduct I have given Chief Guerra a weapon to slay that ugly beast known as police corruption.
Chief Guerra has, in his hands and in his position a mandate for change.
I call upon all Athertonians to let Chief Guerra know that he has your support to clean house. Let him know that you not only support him, but that you expect it of him.
Chief Guerra must be under an enormous amount of extremely uncomfortable pressure right now--the irony here is that this is exactly the kind of moment, that a citizen oversight commission would have been so use full to him as a way to share out that pressure.
Unfortunate for everyone.

don't hold your breath waiting for the Chief to do anything. He serves at the pleasure of the thugs that run Atherton.
