Kim Griffin defends Sequoia Healthcare District

These OpEds prompted San Carlos Councilmember and former Mayor, Matt Grocott, to submit a letter in support of my call for an election to decide the fate of the Sequoia healthcare District. Web Link People should decide fate of health care district&eddate=11/11/2011 04:10:00.

Voter initiated dissolution requires signatures equal in number to at least 15 per cent of the number of votes cast in said proposed district for the office of Governor at the last preceding election at which a Governor was elected. That could require >7500 signatures. San Carlos, or any government agency in the District could also request dissolution, but that is a lengthy, uncertain process. Organizing school Districts and cities to join together in the request might work. (They would get the taxes collected by the District)

The Sequoia Hospital District was established according to the "The Local Hospital District Law."
California Health and Safety Code Enacted June 18, 1945
32003. Whenever the formation of a local hospital district is desired, a petition may be presented at a regular meeting of the supervising authority of the county in which the land, or a greater portion of the land, in the proposed district is situated, said petition to be signed by the registered voters residing within the boundaries of the proposed district, equal in number to at least 15 per cent of the number of votes cast in said proposed district for the office of Governor at the last preceding election at which a Governor was elected. The number of written protests required to terminate the proceedings shall be a majority of the registered voters residing in the proposed district.
32002. The manner of formation of local hospital districts, the conducting of elections, the annexation and exclusion of territory and the consolidation and dissolution of such districts shall be as in the manner provided by "An act relating to governmental units known as districts, and providing a procedure for the organization, operation, government, consolidation and dissolution of such districts," approved June 12, 1933(Stats 1933 p.2280). The provisions of Section 4 of said act and all of the provisions of Divisions I, II, III and IV thereof are hereby incorporated in this division by reference and shall have the same effect and force as if fully set forth herein.

Sec. 626. Upon the filing of a petition with the governing body signed by the number of qualified electors as is required to sign a petition for the formation of the district, the governing body must submit the question of dissolution of the district to the electors thereof.
Sec. 627. Such question may be submitted at the general district election or at a special election called for that purpose.
Sec. 628. The question of dissolution must be submitted not later than the ninetieth day after filing of the petition with the secretary of the governing body.

Here's what the petition might contain:
"Shall the Sequoia Hospital District, created by voters in 1948 with defined powers, now using the appellation “Sequoia Healthcare District” and functioning with assumed powers created for such districts by the Legislature, be dissolved, with assets, liabilities and property tax revenues being distributed according to law."

I hope to agendize a version of this for the Sequoia Healthcare District Board meeting in December. They could read the handwriting on the wall and place it on the ballot. (Then I could retire!)
