Last October, a Menlo Park man attempted to steal prescription drugs from Walgreens and twice succeeded in doing so from CVS over the course of a week.

On June 26, Scott Whitney Davis, a 51-year-old Menlo Park resident, pleaded no contest to charges of robbery, attempted robbery, and robbery with a firearm, on the condition he serve a maximum of 14 years of state prison, according to the San Mateo County District Attorney’s Office.

The case has been continued to Aug. 30, at which point it’s expected that the judge will receive a pre-sentence report and make a sentencing decision, according to prosecutors.

Davis, prosecutors say, entered the Walgreens on Santa Cruz Avenue on Oct. 25 around 7:30 p.m. wearing a mask. According to prosecutors, he gave the pharmacist a note demanding that she give him Xanax, Valium and Oxycontin or he would shoot her. The pharmacist’s coworker then called 911, and Davis reportedly fled with nothing.

The next day at around 9 a.m., he went to the CVS on El Camino Real in Menlo Park and asked for two bottles of Xanax. When the pharmacist asked for a prescription, Davis allegedly lifted his shirt to show a handgun, grabbed the two bottles and fled the store while the police were called; Davis fled the store with the drugs, according to prosecutors.

Two days later, on Oct. 28, at 10 a.m., he allegedly entered the same CVS, wearing a mask. The pharmacist, who recognized Davis, called 911 and left the line open for the dispatcher to hear.

The pharmacist again asked for a prescription and Davis again indicated he had a handgun. He took the Oxycontin and fled on a bike. Police then found and detained him. Upon searching him, they found a loaded Colt 45 revolver. At his home, they found two bottles of Xanax and the demand note.

He previously pleaded not guilty to the charges.

Davis is in custody on $350,000 bail.
