A man charged with sexually assaulting a woman in Menlo Park’s Flood Triangle neighborhood is scheduled to be arraigned on Wednesday, August 30, according to the San Mateo County District Attorney’s Office.
Quincy Powell, 41, is accused of assaulting the woman in her home on the morning of October 3, 2005, prosecutor Gregory Devitt said.
He is charged with three counts of rape and two other sexual assault-related charges, said Mr. Devitt.
Mr. Powell could face a life sentence because he reportedly used a deadly weapon during the assault. He could also face sentencing under California’s “three strikes” law if convicted, the prosecutor said.
Mr. Powell reportedly told the victim he was having car problems, then jumped into her car as she was pulling out of her driveway to help jumpstart his car. He demanded money from her, followed her into her house and assaulted her, police said.
In addition, he was charged with making what Mr. Devitt referred to as “terroristic threats” to the woman, and is accused of stealing cash from her house.
A warrant for his arrest was issued in San Mateo County in June based on “cold-hit” DNA evidence, though the District Attorney’s Office already had leads in the case before matching the DNA. Mr. Powell has been indicted by a grand jury, which was called to expedite the process, Mr. Devitt said.
Mr. Powell is also facing charges in Alameda County for allegedly robbing a bank two days after the alleged sexual assault. He will not face the sexual assault charges until he is tried in the Alameda County case, which is scheduled to begin in November.
He is currently being held in Alameda County.
Bail in the sexual assault case has been set at $2 million, the District Attorney’s Office said.
