Gov. Arnold Schwarzenegger Wednesday signed into law legislation aimed at strengthening the collection of child support in San Mateo County, state Sen. Leland Yee’s office reported.

Though San Mateo County is considered one of the more successful Bay Area counties in collecting child support, about 8,000 children in the county have parents who are delinquent on payments, according to Sen. Yee, D-San Francisco/San Mateo, whose district includes Portola Valley and Woodside.

Senate Bill 523, authored by Sen. Yee, allows judges in San Mateo County to order those required to pay child support, but who are unemployed, to seek work at an initial hearing determining financial support.

Currently, those not paying child support are required to be found delinquent before they can be ordered to seek employment, according to Sen. Yee’s office. A legal process can then take months before any payments are received.

SB 523 is expected to reduce delinquent child support cases, as well as increase the likelihood that payments will be received, according to Sen. Yee.

“While this will not capture every delinquent obligor, it will provide San Mateo County a valuable tool in assisting custodial parents in collecting the child support payments they are rightfully due,” Sen. Yee said in a statement.

The law will go into effect in January.
