An Oakland man who is accused of taking part in a robbery spree, including in Menlo Park, will stand trial, a San Mateo County Superior Court judge determined Thursday.
Daray Antwan Mose, 24, faces charges of two counts of robbery, one count of robbery with a firearm, being a felon in possession of a firearm and assault likely to cause great bodily injury. Conviction on all charges could lead to between about nine-and-a-half to more than 23 years in prison, according to state penal codes.
Mr. Mose allegedly drove a boy to East Palo Alto on July 28, 2016, at 10 a.m. in a white Dodge Grand Caravan. The juvenile allegedly approached a 73-year-old man, brandished a pistol and demanded money. When the elderly man said he had none, the boy allegedly pistol-whipped him in the head, causing the 73-year-old to fall to the ground. The boy took the man’s wallet, and he and Mr. Mose drove away, the San Mateo County District Attorney’s Office said.
Twenty minutes later, Mose and the boy allegedly drove to Menlo Park. The youth exited the van and allegedly pointed a handgun at another male victim, demanding money. The male surrendered his cash, and the boy allegedly demanded his cellphone. When the victim said that he needed the device for work, the boy allegedly stated, “If you don’t give me the phone, I’ll clock you.”
The victim gave up the phone and watched the boy return to the white van. He was able to take down the license plate number, according to prosecutors.
Mr. Mose and the boy allegedly committed seven more armed robberies that same day in Fremont, Hayward and Newark. They were arrested in Fremont later in the day after police chased their vehicle. During the pursuit, Mr. Mose was involved a minor crash and fled the minivan; the boy was arrested while in the passenger seat and found with a loaded gun near his feet. Credit cards belonging to the elderly man robbed in East Palo Alto were also located in the car, prosecutors said.
The East Palo Alto Police Department is the lead law enforcement agency investigating the case.
Four witnesses, including the elderly man, testified during a preliminary hearing on Thursday afternoon, District Attorney Steve Wagstaffe said. Judge Jonathan E. Karesh found there was enough evidence to try Mose on all charges.
Mr. Mose remains in custody on $250,000 bail. He is scheduled to appear for arraignment on Nov. 9.
